Colorado Probate is Not Necessarily a Long Expensive Court Proceeding

Colorado lawyers often advise clients that probate is a long drawn out very expensive court proceeding which is public information.

This is usually not the case. A probate proceeding can be completed for a reasonable fixed fee (in most cases). Colorado law has recently changed to restrict access to court probate files to estate heirs. Probate proceedings are no longer public. Although a probate proceeding must remain open about seven months minimum, much of this time is just a waiting period which is designed to cut off the claims of potential creditors.

However, for many clients, a trust estate plan should be used to avoid both a potential conservatorship (for incapacity) as well as probate. A probate is a waste of money and time which can be avoided with a funded trust estate plan.

An Improperly-Planned Estate Often Results in Disputes

Estate disputes often are the result of a defective estate plan.

For example, the Surviving Spouse should always have some inheritance rights, even if there is an attempt in a will or trust to cut off any such rights. Unless there is a Pre-Nuptial or Post-Nuptial marital agreement, a Surviving Spouse will have certain inheritance rights.

Also, children which are omitted from an estate plan usually have inheritance rights. (They can be disinherited if proper procedures are followed, however this often results in damaged family relationships.)
